As specified in Title 47 of the Code of Federal Regulations (CFR), section § 15.247, which covers operation within the bands 902-928 MHz, 2400-2483.5 MHz, and 5725-5850 MHz, if a device has the capabilities of transmitting on channels 12 and 13, it must meet all relevant emission requirements. If not, the channels in question must be deactivated. The device’s transmission should still operate in compliance with these regulations even if the device should use passive scanning in order to determine if a master is transmitting on these channels.
Following further discussions with key stakeholders, it appears that to ensure correct operation, Wi-Fi client devices rely on access points. In order to confirm that these devices will be compliant in all operation circumstances, some modifications will be required.
These changes and their implementation times have been recognized by the TCB and the FCC, who have granted a transition period until 31 March 2014. The transition period is not only meant to ensure the compliance of new devices, but also that changes will be made to approved products, where appropriate. Throughout this time, devices relying on passive scanning may be approved, however manufacturers are encouraged to implement revisions as soon as possible.
To gain approval for transmitting on Channels 12 and 13, testing is required and the report should clearly indicate that these channels have been tested on the appropriate frequency band. In addition, the reduced output power needed for radiated field strength compliance at the bandedge of 2483.5 MHz should also be included in the grant filing.
